Terms and Conditions

Please review the following basic terms that govern your use of and purchase of products from our Site. Please note that your use of our Site constitutes your agreement to follow and be bound by those terms (the ‘Agreement’).

General

The website and its contents are, owned, operated and controlled by House of Holly Pte Ltd (UEN: 202109666H) (hereinafter referred to as “House of Holly”). Throughout the site, the terms “we”, “us” and “our” refer to House of Holly. House of Holly offers this website, including all information, tools and services available from this site to you (hereinafter known as “The User”), conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you agree to be bound by the following terms and conditions below. We may from time to time change the terms that govern your use of our Site. Your use of our Site following any such change constitutes your agreement to follow and be bound by the terms as changed. By using the Site, you agree to these terms of use; If you do not agree, do not use the Site.

We reserve the right to refuse service to anyone and/or terminate accounts without any reason at any time without prior notice.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Intellectual Property Rights

On this site, including but not limited to the website design, images, photos, graphics, texts, software, code, is the property of House of Holly. Reproduction, modification, transmission, re-publication/re-distribution to third parties for commercial purposes are prohibited without the express written consent from House of Holly.

Prohibited Activities

You agree and undertake not to:

1) Use the Site for illegal purposes or other than in conformance with the acceptable use policies of any connected computer networks, any applicable Internet standards and any other applicable laws;

2) Impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity;

3) Attempt to gain unauthorized access to or otherwise interfere or disrupt other computer systems or networks connected to the Site, interfere with another’s utilization and enjoyment of the Site, or use or upload, in any way, any software or material that contains, or which you have reason to suspect that contains, viruses, damaging components, malicious code or harmful components which may impair or corrupt the Site’s data or damage or interfere with the operation of another customer’s computer or mobile device or the Site; and

4) Post, promote or transmit through the Site any information, graphics, photographs, data and/or any other material that contains any computer virus or other invasive or damaging code, program or macro; infringes any third-party intellectual property or any other proprietary rights; is defamatory, libellous or threatening; is obscene, pornographic, indecent, counterfeited, fraudulent, stolen, harmful or otherwise illegal under any applicable law; and/or is or may be construed as offensive and/or otherwise objectionable, in our sole opinion.

Links To Third Party Sites

The Site may contain links to third party websites that are not affiliated with or owned, operated, or controlled by House of Holly, including third party payment system providers. You acknowledge and agree that House of Holly is not responsible for the content, privacy policies, or practices of such third-party websites or the companies that own them. By using the Site, you expressly relieve House of Holly from any and all liability arising from your access and use of any third-party website.

We encourage you to review the terms and conditions and privacy policies of any third-party websites before using them and disclosing your personal data to them.

Orders & Payment

We accept all major credit cards including Visa, Mastercard, and American Express. For Singapore based customers, we also accept payment via PayNow transfer. For Paynow payments, the order request placed will be on hold for up to 24 hours, within which payment will be due. Otherwise, the order request will be cancelled.

All our prices are in Singapore Dollars (SGD). We reserve the right to modify these at any time. Shipping costs and duties (if any) are not included in the price.

You may place an order with us by completing and submitting the order form on the Site. You shall be responsible for ensuring the accuracy of all orders. All orders will be deemed to be irrevocable and unconditional upon transmission through the Site, and we shall be entitled, but not obliged, to process such order(s) without your further consent and any further reference or notice to you.

We reserve the right to accept or decline any and all orders received from or through the Site in our sole and absolute discretion. Our acceptance of your order will take place when a confirmation email is sent to your registered email address with us, at which point a contract will come into existence between you and us. Each fully-paid order accepted by us shall constitute a separate and individual contract governed by these T&Cs (an “Order”). We will assign an order number to your Order when we accept your Order. Please tell us the order number whenever you contact us about your Order.

If we are unable to process your order, we will inform you of this. This might be because the product is out of stock, because of unexpected limits on our resources for which we could not reasonably plan, because a credit reference we have obtained for you does not meet our minimum requirements, because we have identified an error in the price or description of the product, or because we are unable to meet a delivery deadline you have specified.

The price payable by you for the product shall be the price of the product listed for sale as stated on the Site at the time your order is transmitted to us through the Site. We reserve the right to amend the price of any product at any time without giving any reason or prior notice. Please complete payment at the moment your order was placed as all unpaid orders will be cancelled automatically after a period. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we deliver your order. Payment of the total price plus delivery must be made in full before dispatch of your Products.

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

By placing an order through the Site, you are confirming that you are legally entitled to use the means of payment tendered and, in the case of card payments, that you are either the cardholder or have the cardholder’s express permission to utilize the card to effect payment.

We may refuse to process a transaction for any reason or refuse Service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of refusing or suspending any transaction after processing has begun.

Termination

We may terminate the Order at any time by writing to you if:

• You do not make payment to us when it is due;
• You do not, within a reasonable time of us asking for it, provide us with information necessary for us to provide you with the product (e.g. delivery address);
• You do not, within a reasonable time, allow us to deliver the product to you;

If we terminate the Order in the situations set out above, we will refund any money you have paid in advance for products we have not provided, but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.

Products, Description & Discounts

We have made every effort to display, as accurately as possible, the colors of our products that appear at our Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.

All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Discounts and promotions for our products are also subject to change without prior notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

For customers signed up for email newsletters, a promo code will be sent to the email provided. The promo code is valid for one-time use only. This promotion is only designated to this first purchase and exclude all other selected promotional items. It shall not be used in conjunction with other promo codes and promotions.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

From time to time there may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies or omissions, to change or update information and cancel/void your order/purchase at any time without prior notice (a partial refund will be issued for orders that have overcharged and order will be cancelled when undercharged).

Delivery

The cost of delivery of your Order will be displayed to you on our Site. We offer local shipping and you may refer to our FAQs for more details.

Orders are processed and dispatched from our warehouse within an estimated 2 working days. Standard shipping to the address provided by customers will take an estimated 3-5 working days. Shipping during festive periods may require an addition or 1 working day. Express shipping will take an estimated 1 day (next-day delivery) for orders placed before 5pm. Any delivery dates stated during the order process are estimates only.

If delivery of your product is delayed, we will inform you accordingly and the product will be dispatched after it becomes available. The time for delivery shall not be of the essence, and neither we nor our agents shall be liable for any delay in delivery howsoever caused.

The product will be your responsibility from the time we deliver the product to the address you provided us. You own the product which is the subject of your Order once we have received payment in full for your Order.

Returns

We do not accept any returns or exchanges, except for incorrect items sent and defective products. Purchase of sale items are final and cannot be returned or exchanged.

Incorrect Items & Defects

If you believe you have received the wrong or defective item, contact us at [email protected] with your order number, and a photograph of the item within 10 calendar days from receiving the parcel. We will review your case and may ask you to proceed with a one-to-one exchange of the correct or new item. Only items with tags still intact and are in an unwashed, unaltered and unworn condition will be accepted and can be exchanged. Items should be packed in its original packing material.

We may offer these one-to-one exchange options:

• You may send your item back to us, for which we will bear the cost of return postage. We will send you the correct or new item in exchange once we receive the product.
• The exchange can also be done at our office during office hours from 10am – 6pm. We will contact you to make a prior appointment to ensure our team is able to help you with the exchange.

Minor variations in measurement (within 1 inch) are not considered a defect. You are responsible for ensuring that your sizing measurements are accurate. If you return an item that does not meet the requirements for exchanges set out above, we reserve the right to reject the return and no exchange will be done.

Privacy

Your privacy is very important to us, and we never sell or trade your information with third parties. Please refer to our privacy policy pages for our full privacy policy.

User Comments, Feedback and Other Submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Any feedback you provide at this site shall be deemed to be non-confidential. House of Holly shall be free to use such information on an unrestricted basis.

Amendments

We may revise this Notice from time to time without any prior notice. Any changes will not affect any Orders that you have placed, and that we have accepted, prior to the date of the change. Your continued use of the Site indicates your assent to the T&Cs as posted. You may determine if any such revision has taken place by referring to the date on which this Notice was last updated.
